Overview

India has no dedicated AI statute. AI governance rests on the Digital Personal Data Protection Act 2023 and its 2025 Rules, the Information Technology Act 2000 and the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules 2021 as applied to AI and synthetic media, sector regulators such as the RBI and SEBI, and a series of policy documents: NITI Aayog's Responsible AI approach papers, the IndiaAI Mission approved in March 2024, and the India AI Governance Guidelines released by MeitY in November 2025. Significant Data Fiduciaries face extra duties such as impact assessments and audits. The Act does not mention AI specifically, but it governs the personal data used to train and operate AI systems.
